The Right to Information: A Comparative Study between Constitutional Protection and Islamic Law

Abstract

This study aimed to identify the right of access to information and the importance of information protection by the constitution and Islamic law. In addition to revealing the importance of constitutional protection of the right to information. To achieve the aim of the study, the researchers relied on both, descriptive and comparative method. The problem of the study was to clarify the status of the right to obtain information from the constitutional perspective and Islamic jurisprudence at the same time. The study reached a set of results, the most important of which is that there is no agreement on the use of a single concept of the right to information that can express the essence of this right. There are systems that use “freedom of information” to express the idea of access to information, as well as the “right to information” or “the right to receive information”.
