حكم هَدْم المسجد لإصلاح اتِّجاه قِبلته

الملخص

هدفت الدراسة إلى تسليط الضوء على نازلة فقهية، تتعلق بهدم مسجدها الجامع؛ لإصلاح اتجاه قبلته، بعد اكتشاف انحرافه عن الاتجاه الصحيح للقبلة، ولتحقيق أهداف هذه الدراسة، استَخدم الباحث المنهج الاستقرائي التحليلي، وذلك من خلال تتَبُّع جملة من النصوص الشرعية المتعلقة بموضوع الدراسة، وتوصَّلت الدراسة إلى مجموعة من النتائج، أبرزها أن النازلة موضوع البحث: (هدم المسجد بهدف تصحيح اتجاه قبلته)، وإن وقعَ من قبَل البعض التشنيع فيها، ووضعها في دائرة الحرام، تبقى في نظر الباحث مسألة اجتهادية، يسَع الخلاف فيها، وما قُدِّمَ من حلول، ومقترحات للتعامل مع الانحراف البيّن في قبلة المسجد، لا يخلو جميعُه من إشكالات. وأوصت الدراسة بمجموعة من التوصيات، أبرزها التأكيد على حسن الظنِّ بالناس عموماً، والعلماءِ خصوصًا، مع ضرورة ردِّ النوازل الشرعية المستجِدَّة إلى أُولِي الأمر، خاصة مَن لهم المعرفة التامة بالواقع المحلي للقرية.

The study aimed to shed light on a jurisprudential incident related to the demolition of its congregational mosque to correct the direction of its qibla, after discovering its deviation from the correct direction of the qibla. To achieve the objectives of this study, the researcher used the inductive-analytical approach, by following a number of legal texts related to the subject of the study. The study reached a set of results, the most prominent of which is that the incident that is the subject of the research: (demolishing the mosque with the aim of correcting the direction of its qibla), even though some people denounced it Placing it within the circle of what is forbidden remains, in the researcher's view, a matter of ijtihad, on which there is widespread disagreement, and the solutions and proposals presented to deal with the clear deviation in the qibla of the mosque are not all devoid of problems. The study recommended a set of recommendations, the most prominent of which was emphasizing good faith in people in general, and scholars in particular, with the necessity of returning new legal incidents to those in authority, especially those who have full knowledge of the local reality of the village.
