قانونية إنشاء سد النهضة على نهر النيل والمشكلات التي تواجه دول المجرى والمسؤولية الدولية لأثيوبيا وطرق حل النزاع

الملخص

يعتبر النيل من أقدم الأنهار الدولية من حيث الوجود وأولها من حيث تجمع بني الإنسان حول مجراه ليقيموا على شاطئيه أول جماعة إنسانية سياسية تعيش على أساس من الثبات والاستقرار، وهو بالنسبة لمصر بل ولدول وادي النيل شريان الحياة، فما من نهر في المعمورة يلعب في حياة شعب والقيام بدور بارز في حضارته مثل الدور الحيوي الذي يقوم به نهر النيل بالنسبة لشعب مصر وبالنسبة لمصر ذاتها فهو جوهر الحياة بل هو الوجود كله بالنسبة إليهما وقد أدركت الدولة المصرية المخاطر التي يتعرض لها النيل داخلياً وخارجياً، فسعت إلى اتخاذ حزمة من التشريعات أهمها ما أورده المشرع الدستوري عام 2012. وتوصل الباحث إلى مجموعة من النتائج أبرزها أنَّ النيل لا يعتبر من الأنهار الملاحية في المقام الأول، رغم أن بعض أجزاء مجراه تستخدم في الملاحة بطبيعة الحال، فهو لا يعد شرياناً حيوياً لنقل الأشخاص والبضائع بسبب وجود الشلالات والمستنقعات وبعض العوائق الطبيعية الأخرى في مجراه. وكان دور اللجان المتخصصة بشأن تقدير كميات الطين والطمي والأنقاض التي سيحتجزها السد واضحا وجليا من خلال ما توصلت اليه، والتي يحسب على ضوئها المدى الزمني للسد إذ يفقد كفاءته التخزينية عند امتلاءه بهذه الأنقاض، وإيجاد الحلول الفنية بشأن تحويل المجرى الأصلي للنهر تحويلاً مؤقتاً ريثما يتم حفر الأساسات ووضع القواعد الخرسانية أو الصخرية بها.

It is not considered a vital artery for transporting people and goods due to the presence of waterfalls, swamps and some other natural obstacles in its course. The role of the specialized committees in estimating the quantities of mud, silt and rubble that the dam will contain was clear and evident from what they reached, based on which the dam's time frame is calculated, as it loses its storage efficiency when it is filled with this rubble, and finding technical solutions regarding temporarily diverting the original course of the river until the foundations are dug and concrete or rock foundations are placed in them.
